BDS handed further legal blow by Spanish Courts thanks to ACOM

Huelva Court number 1 has anulled the boycott agreements against Israel adopted by Ayamonte City Council, through a writ issued on September 4, 2018. The resolution was previously suspended by the same Court.

On may 25th 2017 the plenary session of the City Council of Ayamonte (20.000 inhabitants, in Andalusia), passed a decision that engaged the city in the boycott campaign against Israel. This decision was promoted by Recuperemos Ayamonte, the local franchise of Podemos party (radical left) in the city, and passed with the votes of the Socialist Party and IU (Communist party), in spite of the fact they were warned about the illegality of the resolution by the city clerk. Popular Party (centre-conservative) and PA (regionalist party), voted against the resolution.

The Court argues that the content of the declaration “violates Article 14 of the Spanish Constitution”, as it incites and produces discrimination for reasons of birth, race, sex, religion, opinion or any other condition or circumstance, personal or social.

The implementation of ACOM’s legal strategy makes the true extent and the effects of the boycott campaign against Israel clear and exposes the antisemitic and discriminatory nature of the boycott campaign against Israel, that violates both Human Rights and International Law.
Thanks to the legal initiative of ACOM and our international law firm, Cremades & Calvo-Sotelo, which exposed the illegality of BDS resolutions, that discriminate against anyone based on national, ethnic or religious origin, including the Jews, 26 boycott agreements have been annulled.
