Spanish university professor summoned to testify as a suspect in a hate crime investigation following a complaint by ACOM

In May 2024, ACOM – Action and Communication on the Middle East filed a formal complaint in court against Luz Gómez, accusing her of an alleged crime of incitement to hatred. This legal action arose from a message posted by Gómez on social network X.

The complaint, filed by ACOM, is based on the conviction that the post in question constitutes a crime of incitement to hatred, as provided for and punishable under Article 510 of the Spanish Criminal Code. ACOM maintains that the denial and justification of the attack suffered by the Israeli people on 7 October 2023, as well as statements that seek to minimise or trivialise the events that occurred, including the rape of women, cannot go unpunished. These expressions constitute a clear rejection and contempt for the victims of sexual violence.

Following the initial filing of the complaint and a court order, ACOM has proceeded to formally ratify it. As a result of this process, the defendant, Luz Gómez García, has been summoned to testify as a suspect. In the Spanish legal system, the term ‘investigated’ (formerly known as ‘imputado’) refers to a person against whom there is reasonable evidence of involvement in a criminal act.

ACOM reaffirms its firm commitment to the fight against anti-Semitism, insisting that the denial or justification of acts of terrorism and violence has no place in any democratic society.
