The boycott of a Spanish university of Israeli universities and institutions is judicially stopped

The Administrative Court number 3 of Granada, on June 14, 2024, has issued an injunction following the administrative appeal for the protection of fundamental rights filed by ACOM against the agreement of May 17, 2024 of the Governing Council of the University of Granada, which suspends its scientific-technical collaboration and mobility with Israeli universities and institutions.

Said order 223/20244 suspends the enforceability of the agreement adopted by the University of Granada. The measure will be maintained until a final judgment is issued that puts an end to the process.

The court states, literally: “In analyzing all this, we must not lose sight of the fact that the controversial measures directly affect the principle of non-discrimination, personal dignity and academic freedom of the Spanish Constitution, which means that the weighing of interests at stake that must necessarily be done must give prevalence to the guarantee of the aforementioned fundamental rights, In the face of which, we respectfully consider, the University can only assert an ideological interest, since it really does not seem plausible that the harmful measure allows the achievement of any general or public interest that may merit the attention of the judge over the aforementioned fundamental rights“.
