The courts open a criminal case against former Mayor of Barcelona after ACOM files a lawsuit
The lawsuit presented by ACOM at the Provincial Public Prosecutor’s Office of Barcelona against Ada Colau for the alleged crimes of administrative perversion of justice and incitement to hatred has been accepted.
According to articles 101, 109, and 110 of the Criminal Code, on 18 July the legal team of ACOM has presented entry of appearance in order to become private prosecution.
Last 9 February, the City Hall of Barcelona, by Decree of the Mayor’s Office, suspended the agreement of friendship and collaboration with the city of Tel Aviv. Mrs Colau unilaterally dictated a Decree from which derived, among other resolutions, the temporary suspension of relations between the City Hall of the Catalonian capital and the State of Israel.
Days later, we presented a lawsuit at the Provincial Public Prosecutor’s Office of Barcelona requesting the Public Prosecutor to investigate decisions of the then Mayor of Barcelona. Specifically, our lawsuit focuses on the initiative (and its derived effects) unilaterally ordered by Ada Colau that derived in the temporary suspension of relations between the City Hall of the Catalonian capital and the State of Israel.
The actions of the then Mayor of Barcelona, fully arbitrary and unlawful, made ACOM present a lawsuit at the Provincial Public Prosecutor’s Office of Barcelona in order to investigate these acts. Now, after proceedings have started (number 822/23) at the Court of Instruction No 5 of Barcelona, ACOM presents entry of appearance as private prosecution.

This legal initiative of ACOM is added to the administrative-contentious appeal in course against the City Hall of Barcelona for the mentioned decree of the Mayor’s Office, admitted by the Contentious-Administrative Court No 6 of Barcelona.
Thanks to the legal initiative of ACOM, the main denouncer of the discourse of hatred and/or the discrimination for ethnic and national reasons such as the one promoted by Colau, 87 institutional agreements have been annulled to date, 10 of them backed by Higher Courts of Justice, and what is more important, by no other than the Supreme Court. All the rulings have insisted on the unconstitutionality and illegality of these discriminatory measures that violate the common framework of coexistence. ACOM, in its commitment to defend our democracy, will continue to unmask in all sectors, from the legal to the media, all actions that are taken by the antisemites who, in their false solidarity with the Palestinian people, intend to curtail the freedoms of Jews in Spain, in their desire to constantly harass the only Jewish state in the world and the only democracy of the Middle East.
